Understanding the Relationship Between the T1 and T3

A T1 is granted to a victim of human trafficking who wishes to stay in the United States as part of the process of prosecuting human trafficking offenses. It is a non-immigrant visa that is granted to people who would suffer extreme hardship if they were required to leave the country.

The holder of the T1 is permitted to apply for a T3 or other so-called “derivative” visas for family members, including spouse and children if the T1 holder is over the age of 21.

If the T1 holder is under 21, he or she may apply on behalf of spouse, children, parents, and unmarried siblings. Regardless of age, the T1 applicant must be physically present in the United States as the result of human trafficking. Embassies and consulates abroad do not issue the T1.

The T “Derivative” Visa Process

It is expected that, in most cases, people applying for a T3 will have family members who are still living abroad. Relatives living abroad, including children, will need to appear at a consular office in the country of origin to be interviewed by an agent of the State Department.

Interviews are typically waived for those 13 and younger or 80 and older.
